These Terms of Service ("Terms") govern your use of BabyKicks ("the app"), operated by DJUMP, MB. By using the app, you agree to these Terms.

2. Use of the App

BabyKicks helps expecting parents track fetal movements during pregnancy. You may use the app for lawful purposes only. You agree not to:

• Use the app as a replacement for professional medical monitoring or advice
• Attempt to reverse engineer, modify, or interfere with the app's functionality
• Share your account credentials with others (use the partner sharing feature instead)
• Use the app in a way that could cause harm to yourself or others

3. Accounts

You may create an account using email/password, Google, or Apple Sign In. You are responsible for maintaining the security of your account. You can delete your account at any time through the app's Settings, which permanently removes all your data.

4. Kick Counting and Health Information

BabyKicks provides general guidelines about fetal movement (such as "aim for 10 kicks in 2 hours") based on widely accepted medical recommendations. These guidelines are for informational purposes only and should not be considered medical advice.

• The app records kick data as entered by you. It does not independently detect or measure fetal movement.
• Weekly milestone information (baby size comparisons, development facts) is for educational purposes only.
• Kick pattern analysis is based on your manually recorded data and should not be used for medical decisions.
• Always follow the guidance of your healthcare provider regarding fetal movement monitoring.

5. Free and Premium Plans

BabyKicks offers a free tier with core kick counting features and a premium subscription ($3.99/month) with additional features including unlimited session history, pattern analysis, full milestones, PDF export, and partner sharing.

• Premium subscriptions are billed through Apple App Store or Google Play Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage or cancel your subscription in your device's subscription settings
• Refunds are handled by Apple or Google according to their respective policies

6. Partner Sharing

The partner sharing feature (premium) allows you to share your kick session data with one linked partner. You are responsible for sharing your share code only with your intended partner. You can unlink a partner at any time through the app.

7. Intellectual Property

BabyKicks and its original content, features, and functionality are owned by DJUMP, MB. Your kick session data and personal information remain yours.

8. Disclaimer of Warranties

The app is provided "as is" without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or that kick counting data will be perfectly accurate. The app is not a medical device and makes no health-related guarantees.

9. Limitation of Liability

To the maximum extent permitted by law, DJUMP, MB shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app. This includes, but is not limited to, any damages related to reliance on kick counting data, milestone information, or any other health-related content provided by the app. BabyKicks is not responsible for medical outcomes.

10. Privacy

Your use of the app is also governed by our Privacy Policy, which describes how we collect, use, and protect your pregnancy data.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Lithuania.
